This document represents the terms and conditions on which our takeaway service to supply any of the products (the "Products") listed on our site to you. Please read these terms and conditions carefully before ordering any Products from our site.

By accessing our site and placing an order you agreed to be bound by these terms and conditions and our terms of use policy.

INFORMATION ABOUT US

We are an independent fast food takeaway outlet providing a simple and convenient service to our customers. Our interactive menus allow customers to build and submit orders online.

SERVICE AVAILABILITY

Our Takeaway has a prescribed delivery area. This is to ensure that our Products reach you when they are at their best. If you live outside our delivery areas, we would notify you that ordering online for delivery will not be possible. Although you can still buy our Products from us by collecting the order.

Store opening hours are clearly displayed on our site. Ordering time is different from opening hours. This difference is set to allow for food preparation as well as delivery time.

YOUR ORDERS

Placing an order through our site, you warrant that:

You are legally capable of entering into binding contracts; and

You are at least 18 years old and over.

After placing an online order, you will be presented with a screen thanking you for your order and confirming your order number

You should also receive a confirmation email. Please make sure the email address you provide is correct and your mailbox is in proper working order, as all correspondence regarding your order is sent to this address.

Incorrect personal details may lead to problems or delays in delivery, so please ensure that you have included your correct address (including postcode), email address and contact telephone number when ordering.

Delivery charges are clearly marked on our site together with any minimum delivery spend that may apply.

PRODUCTS

We do use nuts in preparing some of our food as well as some of our general preparation ingredients may contain nut. Furthermore our Shop is a busy working environment and there is a risk of cross-contamination between recipe ingredients. If you have an allergy we kindly ask you not to order online. In this scenario, please telephone us and let us know of your allergies directly.

AVAILABILITY AND DELIVERY

All Products are subject to availability. However, in the event of out-of-stock item we will offer an alternative.

Our goal is to provide the best food takeaway delivery service in the market which includes an excellent reputation for on-time delivery. Unfortunately things do not always go to plan and factors, such as weather and traffic conditions, may occasionally prevent us from achieving this.

We will do our best to fulfil your order in accordance with the delivery date and time set out in the confirmation email or, if delivery is specified “as soon as possible”, then within a reasonable time from the time the confirmation email was sent taking into account the number of orders and the circumstances we are encountering at that time. However, we will inform you if we become aware of an unexpected delay.

CANCELLATION

You have the right to cancel an order at any time up until either:

a. in the case of any advance order (which is/are order(s) placed more than 1 day before a requested delivery date), up to 1 day before the order is due to be delivered; or

b. in the case of same day orders and deliveries, within 45 minutes before the order delivery time.

Customers must cancel an order by telephoning only.

However, we reserve the right to cancel any order, before or after acceptance, and will notify you immediately of any such cancellation.

You will not be charged for cancelled orders made in accordance with these above cancellation provisions. Any payment made prior to an order being cancelled by us will usually be reimbursed using the same method originally used by you to pay for your purchase.

However, any order cancelled outside the above cancellation provisions, and in which materials have already been used to prepare the order, will be charged to the customer and no refund will be due to the customer.

It is www.thefryerychippy.com’s discretion to determine whether an order is chargeable or not.

PRICE AND PAYMENT

The price of any Products will be as quoted on our site and may vary from time to time, except in cases of obvious error.

Prices are liable to change at any time, but changes will not affect orders in respect of which you have been presented with the Confirmation Screen.

Despite our best efforts, some of the Products listed on our site may be incorrectly priced. The Shop will normally verify prices as part of the order process.

Payment for all Products can be by credit, or debit card at the time of ordering or in cash on collection. Acceptable cards are clearly identified on the checkout page.

Should you choose to pay by credit or debit card, once your order has been confirmed your credit or debit card will have been authorised and the amount marked for payment is made directly to www.thefryerychippy.com.

To ensure maintaining our prices stay very competitive, all Credit or debit card charges will be added to the order.

OUR LIABILITY

To the extent permitted by law, www.thefryerychippy.com provides our site and content on an "as-is" and "as available" basis and we make no representation or warranty of any kind, expressed or implied, regarding the content or availability of our site, or that it will be timely or error-free, that defects will be corrected, or that our site or server that makes it available are free of viruses or other harmful components.

Subject to the previous paragraph neither www.thefryery.com nor www.thefryerychippy.com’s owners, agents nor employees shall have any liability for any direct, indirect, special or consequential losses or damages (including without limitation, damages for loss of business or loss of profits), arising in contract, tort or otherwise from the use or inability to use our site.

Our liability for losses you suffer as a result of either www.thefryerychippy.com breaking this contract, including deliberate breaches, is strictly limited to the purchase price of the Product(s) you order.





EVENTS OUTSIDE OUR CONTROL

We at www.thefryerychippy.com will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a contract that is caused by events outside our reasonable control (a "Force Majeure Event").

 A Force Majeure Event includes any act, event, non-happening, omission or accident beyond our reasonable control

OUR RIGHT TO VARY THESE TERMS AND CONDITIONS

www.thefryerychippy.com has the right to revise and amend these terms and conditions from time to time. Any changes we make to these terms and conditions will be posted on this page. You will be subject to the policies and terms and conditions in force at the time that you order Product(s) from www.thefryerychippy.com, unless any change to those policies or these terms and conditions is required to be made by law or governmental authority.

LAW AND JURISDICTION

Contracts for the purchase of Products through our site and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) will be governed by English law in England and Wales and Scottish law in Scotland.
